These Terms and Conditions (“Terms and Conditions”) govern the use of the website www.maxproducts.co.za (“the Website”) by you (“the User”). The Website is owned and operated by Cape Automotive Products trading as Max Products (“the Provider”).

By accessing and using the Website, the User agrees to be bound by these Terms and Conditions.

The User may not access, display, use, download, copy or distribute any content obtained from the Website for marketing or commercial purposes without the prior written consent of the Provider.

Electronic Communications

By using the Website or communicating with the Provider by electronic means, the User consents to and acknowledges that all agreements, notices, disclosures or other communications sent electronically satisfy any legal requirement, including the requirement that such communications be in writing.

E-commerce and Privacy

The Website www.maxproducts.co.za sells cleaning products. The use of any product or service purchased from the Website is entirely at the User’s own risk.

The User indemnifies and holds the Provider harmless against any loss, injury or damage of whatsoever nature that may be suffered as a result of using the products sold on the Website.

All personal information required to process orders placed through the Website, including personal details, delivery address, telephone numbers and payment information, will be treated as strictly confidential and will not be sold or disclosed to third parties.

Only the information necessary to complete delivery, namely the delivery address and contact telephone number, will be shared with third-party delivery service providers.

Credit card details are not stored by the Provider under any circumstances.

The Provider cannot be held liable for any security breaches on the User’s electronic device, including a personal computer or mobile device, arising from inadequate virus protection, malware or spyware installed on the User’s device.

All goods will be supplied to the delivery service provider in good order. The Provider will not be held liable for the condition of goods upon arrival at the User’s chosen delivery address.

Credit card payments are processed by PayFast, a secure South African payment gateway. Card holders may refer to the PayFast website for details of their security policies.

Warranty and Returns Policy

The supply of goods and services is subject to availability.

All chemical products carry a three-month warranty from the date of purchase. Electronic products are subject to the warranty provided by the relevant supplier.

In the event that goods are unavailable, the Provider will refund the User in full within 30 days.

Should the User cancel an order, a 15 percent administration fee will be charged.

The Provider reserves the right to cancel any order for which payment has already been received if stock is unavailable or if the goods do not meet the Provider’s quality standards. In such cases, the User will receive a full refund with no deductions.

Any complaints regarding the quality or standard of products purchased through the Website must be directed to the business owner at admin@maxproducts.co.za.

Amendments to Terms and Conditions

The Provider reserves the right to amend, modify, add to or remove any part of these Terms and Conditions at any time.

Any changes will take effect once published on the Website. It is the User’s responsibility to regularly review the Terms and Conditions for updates.

Continued use of the Website after changes have been posted will constitute acceptance of the updated Terms and Conditions.

Copyright and Intellectual Property

All information and content displayed on the Website is provided by the Provider, its affiliates, subsidiaries or third-party content owners, and includes, but is not limited to, cleaning chemicals and computer programs (“the Content”).

All Content and related intellectual property rights are protected by South African and international copyright laws and remain the property of the Provider or the respective rights holders.

The Provider reserves the right to make changes to the Website, its Content, and the products or services offered at any time without notice.

No licence or right is granted to the User in respect of any copyright, trademark, patent or other intellectual property right, except as expressly stated in these Terms and Conditions.

Limitation of Liability

The Website and all Content are provided on an “as is” basis. The Content may contain inaccuracies or typographical errors.

The Provider makes no warranties or representations regarding the availability, accuracy or completeness of the Content.

Neither the Provider nor its directors, employees, affiliates or subsidiaries shall be liable for any direct or indirect, special, consequential or incidental damages arising from the use of, or inability to use, the Website, the Content, or any linked website, even if the Provider has been advised of the possibility of such damages.

Privacy: Casual Browsing

Users may browse the Website without providing any personal information.

In such instances, the Website servers may collect the User’s IP address but not their email address or other personally identifiable information.

This information is used in aggregated form to analyse website usage and improve the Content. The Provider assumes no obligation to protect this information and may use it without limitation.

Governing Law

This Website is operated and administered by the Provider from the Republic of South Africa.

Access to the Website from countries or territories where the Content or sale of products is unlawful is prohibited.

Users accessing the Website from outside South Africa are responsible for compliance with all applicable local laws.

These Terms and Conditions are governed by the laws of the Republic of South Africa, and the User consents to the jurisdiction of the Western Cape High Court in respect of any dispute arising from the use of the Website.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.

These Terms and Conditions constitute the entire agreement between the Provider and the User regarding the use of the Website and its Content.
